It is absolutely fundamental to the rule of law, to the right to a fair trial, to the right to liberty and security of person, and to the right to effective remedy for violations of human rights, that individual judges and the judiciary as a whole must be independent and impartial. Politicians must not tamper with the judiciary. Judges must have security of tenure. They need to be free from political interference. According to the Human Rights Committee of the UN – General Comment No. 32, article 14: Right to equality before courts and tribunals and to a fair trial – “is an absolute right that is not subject to any exception”.
